2.1 Our Ethos

Rothko & Frost is a shop for makers, by makers. We provide pristine raw materials—carving blocks, turning blanks, and knife-making supplies—to fuel your creative journey. Our policies reflect a deep respect for the integrity of the making process.

2.2 Target Audience

Our Site and services are intended for responsible adults engaged in woodworking, carving, turning, and blade crafting. By purchasing our materials, you confirm you have the necessary skill, tools, and environment to handle them safely.

3. Products & Services Description

3.1 Product Nature

We sell raw, unworked materials and tools. Each piece of wood or steel is a natural product and may contain variations in grain, color, density, or minor imperfections that are inherent to the material, not defects. These characteristics contribute to the uniqueness of your finished work.

3.2 Non-Returnable Items

Due to the nature of craftsmanship and for community safety, the following are final sale and cannot be returned or exchanged:

• Custom-Cut or Finished Items: Any material altered from its original sold state (cut, shaped, carved, turned, etc.).
• Used or Sharpened Tools & Blades: Any tool showing signs of use, wear, or sharpening.
• Clearance or “As-Is” Items: Items explicitly marked as such.

Once you begin working on a material, it becomes a unique part of your creative journey and is no longer resalable.

4. User Obligations & Responsibilities

• Accurate Information: You agree to provide accurate, current, and complete information during account registration and checkout.
• Lawful Use: You agree to use our products lawfully and safely, in accordance with all local, state, and national regulations.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Prohibited Conduct: You may not use the Site for any fraudulent or unauthorized purpose, or interfere with its security or functionality.

5. Orders & Payment Terms

5.1 Order Processing

All orders are processed within 1-2 business days (excluding weekends and holidays) from our workshop in Oakland, California, USA.

5.2 Pricing & Payment

Prices are listed in US Dollars. We accept Visa, MasterCard, JCB, and PayPal. You authorize us to charge the total amount, including shipping and applicable taxes, to your selected payment method.

5.3 Shipping & Delivery

We ship globally, excluding some remote regions in Asia and other specified areas. You are responsible for any import duties, taxes, or customs fees.

• Standard Shipping: $12.95 via DHL/FedEx. Estimated delivery 10-15 business days after shipment.
• Free Shipping: Available on orders over $50 via EMS. Estimated delivery 15-25 business days after shipment.

Delivery times are estimates. We are not liable for delays caused by carriers, weather, or customs.

5.4 Order Changes & Cancellations

You may request to cancel or modify an order by emailing us immediately at [email protected]. We will accommodate requests only if the order has not yet entered the processing or shipping stage.

6. Returns, Exchanges & Refunds

Our full Returns & Exchanges Policy is detailed on our homepage and incorporated here by reference. Key points include:

• Eligibility Window: Return requests must be initiated within 15 days of receipt.
• Condition: Items must be unused, unaltered, in original packaging with proof of purchase.
• Process: Contact us for an RMA number before returning. Customer is responsible for return shipping costs unless the error is ours.
• Refunds: Issued to original payment method within 5-7 business days after inspection, plus 5-10 days for bank processing. Original shipping fees are non-refundable.
• Damaged/Incorrect Items: Contact us within 48 hours of delivery for a prepaid return and expedited resolution.

7. Intellectual Property

All content on the Site—including text, graphics, logos, images, and software—is the property of Rothko & Frost Shop or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

By submitting photos or reviews of your work using our materials, you grant us a non-exclusive, royalty-free license to use that content for promotional purposes.

8. Limitation of Liability

To the fullest extent permitted by law, Rothko & Frost Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products.

Our total liability for any claim related to your order shall not exceed the purchase price of the product(s) in question. We provide raw materials; you assume all responsibility for the safe and proper use, handling, and sharpening of tools, and for any projects you undertake.

9. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Alameda County, California.

10. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. The most current version will always be posted on the Site with the updated effective date. Your continued use of the Site after changes constitutes acceptance.
